Tampa Mayor Bob Buckhorn did right by indulging in some drama this week with his cleanup plan for Sulphur Springs. The central Tampa neighborhood has come to symbolize urban blight, and having the mayor crash a piece of heavy equipment through an abandoned home said as much about the need to transform the area as it did about the mayor's commitment to see it through.
The city announced it would demolish 51 abandoned houses in Sulphur Springs in the next six months. All have been the target of code enforcement actions, and all are uninhabitable. The demolitions will cost $5,500 apiece, and afterward, the city will maintain the lots with the goal of attracting developers to build new, single-family homes.
The abandoned homes are eyesores that drag down entire blocks and attract prostitution, drugs and other criminal activity. Getting rid of them is the first step in changing the image of the neighborhood and attracting new investment. The city will also staff three full-time code enforcement officers for Sulphur Springs.
The city will need to do more to address the chronically poor conditions that stigmatize the area. The installation of new streetlights, which the city and Tampa Electric Co. announced this week, will help. The city needs to continue looking for better housing opportunities, and continue the targeted crime and code enforcement sweeps that have helped to raise living standards in the area. It should also look for ways to enliven the appeal of two major parks that border Sulphur Springs, both of which occupy sweeping banks on the Hillsborough River. Buckhorn, though, is bringing resources and mayoral attention to an area that has suffered from years of neglect. Any turnaround will require sustained action on the mayor's part.

TAMPA — The Tampa Police Department says Sgt. Ray Fernandez did nothing wrong last week when he dispatched two officers on a tip from a longtime attorney friend that a man at Malio's Prime Steakhouse drinks and drives.
Officers ended up arresting that man, C. Philip Campbell, who happened to be the opposing counsel in a contentious shock jock defamation trial involving his friend's firm.
The DUI arrest threw the trial into chaos, with cries of a setup and calls for a mistrial.
It also raised a question:
Do officers typically investigate citizen tips that someone might drive after drinking?
Officials from sheriff's offices in Hillsborough and Pinellas counties said no. So did the St. Petersburg Police Department.
"If somebody is drunk at a bar, they've not broken the laws," said Sgt. David DiSano, Pinellas Sheriff's Office spokesman.
Said Hillsborough Sheriff's Office spokeswoman Debbie Carter, "We don't have enough deputies to send to sit out in front of every bar."
But Campbell had a previous DUI arrest. And Fernandez had been called with similar concerns a month before, the sergeant would later testify.
"Getting two calls, coupled with a 2008 DUI arrest, established a pattern of driving under the influence that makes him a more egregious violator and a more serious threat to our citizens," said Tampa police spokeswoman Laura McElroy. "These factors would make following up on the second tip a priority."
Campbell had stopped at Malio's Wednesday after a full day in court representing Todd "MJ Kelli" Schnitt in his lawsuit against fellow shock jock Bubba the Love Sponge Clem.
According to court testimony, Campbell chatted with other lawyers and a woman who never revealed her full name, Melissa Personius, or the fact that she is a paralegal for Adams & Diaco. the firm representing Clem.
Campbell talked about his big case, according to testimony; the woman ordered drinks.
Fernandez testified last week that he got a tip about Campbell some time between 7:30 p.m. and 7:45 p.m. from Adam Filthaut, an attorney with Adams & Diaco. The sergeant, who is godfather to Filthaut's son, sent two officers to the Malio's area.
Police "sat on that location,'' according to Fernandez's testimony. Campbell was pulled over at 9:57 p.m. Records show it was Fernandez who watched him violate the right of way of another vehicle and then, upon making contact, noted glassy eyes and the smell of alcohol. Another officer confirmed his observations.
"If we had failed to investigate it and his driving resulted in a DUI crash with injury or death," McElroy said, "Sgt. Fernandez and our department would have to live with those results and face the consequence."
Fernandez's personnel file with the Tampa Police Department, which dates to September 1994, is full of accolades for his proactive approach supervising DUI officers the past four years. He deploys them to areas with the highest number of DUI traffic accidents. Each member of his squad averages more than 100 DUI arrests per year.
He has never fallen below expectations, the file shows. He got an "exceeds expectations" mark this past year for his "initiative."
"It is disheartening," McElroy said, "that he was a pawn in this situation."
The department said Fernandez would not be commenting. Attempts to reach Filthaut were unsuccessful.
Meanwhile, week three of the trial continued Monday, with Schnitt's attorneys' request for a mistrial still hanging and the judge holding off on a ruling. He quickly denied a motion Monday for a mistrial from Clem's defense, which was based on publicity over the weekend. "I'm sure there will be a lot more intense investigation on those issues," Arnold said. "But that's not for me at this time."
Maybe not for him, but attorneys on both sides have subpoenaed each other, prompting stern words from the judge. "If you want to have a dog fight over this, you can have a dog fight over this," the judge said. "But it's not going to be right now."
All attorneys are protected from being called to testify while the defamation trial goes on, Arnold said.
"Right now, we are going to finish this trial," the judge said. "Don't even try to bog us down with any other issues at this time."
The judge continued to poll jurors to make sure they have not been exposed to any trial publicity. After the sideshow made Good Morning America, he added an admonition not to read, watch or listen to any reports about this case, local — or national.

How'd it feel when you learned the guy who "manipulated" you was so stupid as to have his hooker give the keys to her car to him? And the tipster knew it was going to happen because he gave you the description of HER car - not Campbells.
Oh - by the way, Laura - you need to talk with your chief before you say a lot more. The problem is you are saying what deputy Fife did was a good thing but your chief is saying he was "manipulated." You can see how that makes your spin wobble a bit.

Also from her statement she is saying that Fernandez knew Campbell was the target because she claims Fernandez knew about his prior DUI before he sent out the officers. That leads to the next logical question, if Fernandez knew the name did he know he was the lawyer on the other side of his friend's firm's big case, that has been going on for five years?
I was thinking that the comments posted before by someone with the name Tampa Police Department were posted by someone who had nothing to do with TPD. After reading McElroy's clueless comments I am starting to think it was her.

Campbell will file suit against these stagehands for Malicious Prosecution, for intentionally causing his arrest and also abuse of process if they continued to stretch the truth after the arrest. This can also be brought criminally by the State Attorneys office, hence the invocation of the 5th Friday.

What matters is the cops are used by the private citizen to harass someone else. As the sheriff's departments said, sitting at a bar drunk is not a crime and that's not what the tip was about. The cops assisted the tipster by sitting for two hours on the bet the guy MIGHT violate the law. Call the cops sometime and tell them you think the guy down the street is going to rob a bank. See if they send a couple of cops out to ambush him on the way to the bank.

He was arrested for DUI, not refusal to take the breath test. To be charged with that you have to have refused a breath test before. In the 08 case Campbell took the breath test, so he can not be charged with the criminal charge of refusal.

You're missing the point. We will never know if Campbell was drunk or not because his arrest was tainted by the set up. It will cost the taxpayers money and the State other DUI cases. It also will make it easier for defense attorneys to put doubts about law enforcement in the minds of juries. The longer TPD covers for Fernandez, the worse it all gets.

In a DUI case the opinion of the officer is very important to prove the case. It is even more important if the defendant refuses the breath test. If the officers involved are shown to have other motives then their word is not worth much. That is how you taint a DUI arrest.

The same Sgt who dispatched two officers to sit for 2 hours to catch a guy that by all accounts was walking until the paralegal sweet talked him into driving her car. Also anyone who knows anything about "tips" knows that when you get a bad one it makes any other tips from the same person less reliable, not more reliable.

When TPD pulled the paralegal's car over, didn't they run the tag like they do in every other traffic stop? If so, they would have seen her DL is on a 5 yr revocation. So why did they let her drive her car away? They always check the passengers to see if 1) they're impaired too - wasn't she also drinking?- and 2} if they have a valid license. How come not this time?

Personius will be stripping soon! The Diacos will get sanctioned by the bar association & poor Phil Campbell will get Spanked by the DMV even if he is found to have been set up for his DUI. The criminal part & the DMV part are 2 separate matters. The crinianl part will get tossed out but since he is required to submit to a BAC test when asked by law enforcement & he refused he will be spanked by the DMV! 2 DUI's within 5 years is a bad thing & Phil is gonna have a hard time. The DMV can be more harsh than the court system sometimes. It will be interesting to see how it unfolds.

But, Fernandez had two cops waiting for two hours to make the stop. They had a description of the car - but it was not Campbell's car. He and the tipster are close friends and someone this morning commented a similar setup by the same tipster and Fernandez was tried a month ago but didn't work. It surely looks like a setup and, if Fernandez has any sense at all, he should have known it. It also has not been established Campbell was intoxicated. He refused the BAC. Presumably they have a dash-cam video of his field sobriety test which might show his impairment. I'm bettinf Fernandez was doing a favor but he didn't know the tipster and paralegal were so stupid as to use her car. When he learned that, he probably started banging his head and cursing his idiot lawyer friend.

He already is. In Florida the ticket for DUI is the charging instrument and since this happened in Tampa is is effectively already an active case for the state attorney. He can choose to drop the charges but, make no mistake, he is now involved.

Mark my word. The city of Tampa Police Department is setting the taxpayers up for a 28 U.S.C. 1983 lawsuit by Campbell.
28 U.S.C. 1983 provides:
"Every person who, under color of any statute, ordinance, regulation, custom, or usage, of any State or Territory or the District of Columbia, subjects, or causes to be subjected, any citizen of the United States or other person within the jurisdiction thereof to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws, shall be liable to the party injured in an action at law....."
These facts scream for punitive damages. A police sergeant conspiring with Adams and Diaco to set the lawyer up by having the paralegal get him drunk and persuade him (who walked to the bar) to drive is entrapment and nothing less. Shocking.
Chief Castor had better take concrete steps to show that the City opposes this type of police misconduct. At a minimum, Sergeant Fernandez needs to lose a couple of stripes and get a 90 day suspension.
Fernandez is not a simple patrol officer, he is a higher ranking official who called the shots, not for good law enforcement, but to help out a very good friend with his abuse of power.
If the city fails to act their conduct shows they approve of this violation of civil rights. The taxpayers better get ready to pay.

Usually, a citizen-tipster is a good thing; even an anonymous tip can create probable cause, if corroborated by observation. As long as the officer can "articulate" an objective basis for his stop, there's nothing wrong with it. His subjectiv3e motivations are irrelevant, thanks to the Supremes. Likewise, how he got drunk is irrelevant as well, at least to the arrest which owuld be the basis of hte 1983 action. He just got punked big time; stepped on his "tie".

As I understand it, this was the second time Sgt Fernandez set the trap based on Filthaut's "tip". He came up empty the first time.
He doesn't sound like a reliable tip for probable cause purposes unless he had additional information for Sgt Fernandez such as "my paralegal is getting him drunk and will walk him to her car and "persuade" him to drive. He will be driving a ..... and the car is parked four blocks away from Malio's in a parking garage".
After a two hour stake-out it happens.
Of course the articulated reason for the stop was that Campbell failed to yield to another motorist. The cameras don't lie. Of course, the cameras probably weren't working.
And who is to say he was drunk, unless the paralegal wants to pipe in and quantify how much she bought him.
I'm no expert on 1983 cases but I hope that cops cannot knowingly be part of a plan that is hatched to put a person on the road who was walking to begin with. It doesn't pass the smell test.

Just because he had a drink doesn't mean he was impaired. If the cop was dirty enough to be in on the setup what makes you think he isn't dirty enough to arrest him without him being legally drunk? The goal would have been to smear his name and force a mistrial. They don't care if he actually is guilty. They just don't want their client to be guilty.

These are the people citizens turn to for truth, direction and protection - that is wavering right now (based on all the comments from various people on the last article) and someone, anyone needs to step up and show they can be trusted and that they will do the right thing. Community leaders are held to a higher standard, now is the time for them to shine and prove they are deserving of their positions.

Don't forget Sgt. Fernandez said he has sent his officers out about a month ago to do the same thing on the same "tip" from his friend and they were not able to arrest Campbell. I guessing TPD would be even less likely to use your tip if you had sent them on a wild goose chase before. Unless of course the cop is your friend and he wants to help you by getting someone arrested.
